The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, IMP’s Privacy Policy) and procedures that may be published from time to time on this Site by IMP (collectively, the “Agreement”).
Copyright Infringement and DMCA Policy. As IMP asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by indiemusicplus.com violates your copyright, you are encouraged to notify IMP in accordance with the Digital Millennium Copyright Act (“DMCA”) via legal (at) indiemusicplus.com. IMP will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. In the case of a contributor who may infringe or repeatedly infringes the copyrights or other intellectual property rights of IMP or others, IMP may, in its discretion, terminate or deny access to and use of the Website.
Intellectual Property. IMP, Indie Music PLUS, indiemusicplus.com, the indiemusicplus.com logo, Indie Music LIVE, and all other trademarks, service marks, graphics and logos used in connection with indiemusicplus.com, or the Website are trademarks or registered trademarks of Indie Music Plus, Inc. or IMP’s licensors. Other trademarks, service marks, graphics and logos used in connection with the Website may be the trademarks of other third parties. Your use of the Website grants you no right or license to reproduce or otherwise use any IMP trademarks.
Music and Video Submissions. All music and videos submitted to the IMP website, IMP email, and store must be original compositions written and performed by at least one member of the group or band. Covers and mixtapes are permitted so long as the music is properly licensed. By submitting music and videos to IMP, you agree to give written permission to IMP, and automatically do so by submitting through website, for your music and/or video to be used on the IMP YouTube channel, and other Social Media channels, for the purposes of promoting the music. We do not under any circumstances guarantee a positive critique. We speak our mind and our feedback is strictly our opinion.
Emails. By submitting music, video, or written content to IMP, you agree to receive occasional emails from IMP about news, discounts, events, etc. Ordering a service from the IMP Store acts as your consent to receive emails, and filling out the Quiz for free submissions (i.e. 5 + 4=?) acts as your consent to receive emails as well. To be removed from the IMP mailing list, simply unsubscribe or request removal to: info (at) indiemusicplus.com. IMP will never share or sell your email address to any 3rd party brand or service.
Refunds. Payments to IMP for promotion of music that has very poor quality (i.e. cell phone recordings) will kindly be refunded automatically. For all other payments to IMP to promote acceptable quality music, you agree to follow the respective guidelines in the description of each service at the IMP store, and once work begins payments are non-refundable.
Changes. IMP reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. IMP may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.
Disclaimer of Warranties. The Website is provided “as is”. IMP and its suppliers and licensors hereby disclaim all warranties of any kind. Neither IMP nor its suppliers and licensors, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that you obtain content or services through, the Website at your own discretion and risk.
Indemnification. You agree to indemnify and hold harmless IMP, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.
